Terms and Conditions

We have drafted these Terms and Conditions (the “Terms”) so that you know the rules that govern our relationship with you. These Terms form a legally binding contract between you and Creative Frenzy Private Limited, operating the KahaniTv platform. Please read them carefully.

By accessing or using the Services, you agree to these Terms, the Privacy Policy, Refund Policy, Content Moderation Policy, Grievance Redressal Policy and Copyright Policy. If you do not agree, do not use the Services.

1. Who we are and what KahaniTv is

KahaniTv is an over-the-top entertainment service of Creative Frenzy Private Limited, with registered office at D-247/1, Sector 63 Rd, D Block, Sector 63, Noida, Uttar Pradesh 201309, India. The Services include our website, mobile applications and any related players, features or content we make available now or in the future, through which we offer short dramas, stories, series and similar audio-visual entertainment (“KahaniTv Content”).

KahaniTv is not a dating platform, live companion service or video-calling marketplace. Features, catalogue and pricing may differ by device, territory and plan.

2. Who can use the Services

No one under 18 is allowed to create an account or use the Services. We may offer additional Services with additional terms that require you to be even older. You represent that you have the legal capacity to enter these Terms and that the information you give us is true.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly if you suspect unauthorised use.

3. Licence to use the Services

Subject to these Terms and timely payment of any applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access KahaniTv Content for your private, non-commercial viewing on supported devices. You do not acquire any ownership of KahaniTv Content, software, trademarks or other intellectual property.

You must not:

• Copy, download (except where an official offline feature is provided), redistribute, broadcast, publicly perform, or commercially exploit KahaniTv Content.
• Circumvent, disable or interfere with security, geo-restriction, parental controls, DRM or usage limits.
• Use bots, scrapers or unauthorised tools to access the catalogue or accounts.
• Share your account in a way that reasonably appears to be a commercial resale or public exhibition.
• Reverse engineer the applications except to the limited extent permitted by mandatory law.
• Use the Services for any unlawful purpose.

4. Subscriptions, trials and payments

Some content is available only with a paid subscription, rental, coin/credit pack or other in-app purchase. Prices, taxes, billing cycle and catalogue access are shown at checkout and may change for future cycles.

If you buy through Google Play, Apple App Store or a similar store, their billing terms also apply and refunds must generally be sought from that store. If you buy on our website or through a payment gateway we appoint, charges are processed by that gateway. We do not store full card numbers or CVV.

Auto-renewing plans continue until you cancel. Cancel before the renewal date to avoid the next charge. Cancellation stops future billing; it does not, by itself, refund the current period except as stated in the Refund Policy or required by law. See the Refund Policy for timelines and exceptions.

5. Your content

If KahaniTv lets you post, upload, comment, rate, message or otherwise transmit material (“Your Content”), you are solely responsible for it. KahaniTv, and Apple or Google if you downloaded the Software from their stores, are not responsible to you or any third party in connection with Your Content.

You agree to pay all royalties, fees and other amounts owing to any person by reason of Your Content. You represent and warrant that: (a) you are the creator and owner of, or have the necessary rights to transmit or display, Your Content; and (b) Your Content does not and will not (i) infringe, violate or misappropriate any third-party right, including copyright, trademark, patent, trade secret, moral right, privacy, publicity or other proprietary right, or (ii) slander, defame, libel or invade the privacy, publicity or other property rights of any person.

Violators of these third-party rights may be subject to criminal and civil liability. KahaniTv reserves all rights and remedies against anyone who violates this section.

You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt and display Your Content solely to operate, improve and promote the Services. We may remove Your Content that we reasonably believe breaches these Terms, our policies or law.

6. Acceptable use

You agree not to:

• Harass, threaten, stalk or abuse any person in connection with the Services.
• Post or transmit unlawful, obscene, pornographic (where not permitted by the rating of the Service), hateful, defamatory or infringing material.
• Impersonate the Company, another user, or any person or entity.
• Interfere with other users’ enjoyment of the Services or attempt to gain unauthorised access to systems or data.
• Use the Platform to solicit dating, companionship-for-pay, or live interactive social services that KahaniTv does not offer.

7. Content availability and changes

KahaniTv Content is licensed from rights holders or produced by us or our partners. Titles may be added, removed, edited or geo-blocked at any time. We do not guarantee that any particular title will remain available, or that the Service will be uninterrupted, error-free or available on every device or network.

We may modify, suspend or discontinue features, including for maintenance, legal, commercial or security reasons.

8. Third-party services

The Services may link to or integrate third-party services (app stores, payment apps, analytics, ads, social login). Their terms and privacy policies govern those services. We are not responsible for third-party practices.

9. Termination

You may stop using the Services and request account deletion as described in the Privacy Policy. We may suspend or terminate access, without refund except where required by law or the Refund Policy, if you breach these Terms or our policies, if we are required to do so by law, or if we discontinue the Service.

10. Disclaimers and limitation of liability

THE SERVICES AND KAHANITV CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS DIRECTORS, EMPLOYEES AND PARTNERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA OR GOODWILL. OUR TOTAL LIABILITY ARISING OUT OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICES IN THE THREE (3) MONTHS BEFORE THE CLAIM, OR ONE THOUSAND INDIAN RUPEES (INR 1,000), WHICHEVER IS HIGHER. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER INDIAN LAW, INCLUDING LIABILITY FOR FRAUD OR FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE WHERE SUCH LIMITATION IS PROHIBITED.

11. Indemnity

You agree to indemnify and hold harmless the Company and its officers, directors, employees and agents from claims, damages, losses and expenses (including reasonable legal fees) arising from Your Content, your use of the Services, or your breach of these Terms or applicable law.

12. Changes to the Terms

We may revise these Terms. We will post the updated Terms on the Platform and update the date above. Where a change is material, we will, where reasonably practicable, give additional notice. Continued use after the effective date constitutes acceptance.

13. Governing law and contact

These Terms are governed by the laws of India. Subject to any mandatory consumer forum, courts at Gautam Buddha Nagar, Uttar Pradesh shall have exclusive jurisdiction.
